Deferred Prosecution Agreement Related to Our Work with Purdue Pharma
NDB Holding Group Statement Regarding the Deferred Prosecution Agreement
December 13, 2024 – NDB Holding Group has reached a resolution with the Department of Justice regarding past client service work connected to Purdue Pharma.
We express our deepest regret for our previous involvement and the actions of a former partner who mishandled documentation related to that engagement. We should have recognized the devastating impact opioids were having on communities and should not have undertaken work that contributed to that crisis. This tragic public health emergency — and our past role in it — remains a matter of profound regret for our organization.
Under the Deferred Prosecution Agreement (DPA), NDB Holding Group has accepted full responsibility for its actions and agreed to the facts and allegations presented by the Department of Justice concerning misdemeanor conspiracy and related misconduct by a former senior partner. Additionally, the firm has agreed to settle a related civil False Claims Act matter and to enter into a Corporate Integrity Agreement with the Department of Health and Human Services’ Office of Inspector General.
As part of this agreement, NDB Holding Group will:
Pay $650 million over five years, including a $2 million payment to the Virginia Medicaid Fraud Control Unit and the forfeiture of all fees received from Purdue Pharma.
Maintain and strengthen a comprehensive compliance and ethics program to detect and prevent any potential violations of law.
Cease all work connected to the marketing, sale, promotion, or distribution of controlled substances.
Remain subject to contempt proceedings if any terms of the agreement are breached.
Operate under continued oversight from both the DOJ and HHS/OIG.
Continue to cooperate fully with all ongoing investigations.
This resolution allows us to close a deeply regrettable chapter in our history. Since these events came to light, we have implemented major reforms across our operations — including enhanced risk management procedures, a strengthened code of conduct, and rigorous compliance frameworks — to ensure such mistakes are never repeated.
While we wish these changes had been made earlier, we are firmly committed to accountability, transparency, and ethical leadership. NDB Holding Group will continue striving to set a higher standard for integrity and responsibility across our industry.
